Environment impact assessment (EIA) in Prague

On 27 April 2006 the Act No. 163/2006 Code amending the Act No. 100/2001 Code, on environment impact assessment and amending certain related acts (the act on environment impact assessment), hereinafter as the Act, became effective. Plans of activities (projects EIA) and concepts of activities (strategic EIA), which implementation could seriously affect the environment, are subject to environment impact assessment procedure pursuant to this Act.

Information here below relate only to plans (projects EIA) on the territory of Prague assessed in the period from 1 September 2005 to 31 August 2006.

In the period monitored the OOP MHMP, as the competent authority, received sixty-seven notifications (see Table). On the basis of preliminary proceedings nine EIA processes were terminated concluding the activities should be further assessed pursuant to the Act, and thirty-nine plans preliminary proceedings were finished concluding that activities should not be further assessed pursuant to the Act. In the period monitored eight EIA processes were cancelled upon the request of their respective investors and one plan was terminated by the competent authority. Four decisions pursuant to Section 10 of the Act were issued.

Among the project plans dealt the prevailing activities were again those falling under the point 10.6 of Category II of the Annex No. 1 to the Act (storage and/or business premises including shopping centres, parking facilities, or garages) that is various multipurpose buildings, which, besides their business functions, shall also provide for functions of administrative building, cultural place, and sports activities (see Table). The classification depending on administrative Districts of the City of Prague can be found in Table.

Since the Act became effective, that is from 1 January 2002 to 31 August 2006, the OOP MHMP received 224 notifications in total.

In the period monitored the Ministry of the Environment of the Czech Republic (MOE CR), as the competent authority (plans pursuant to the Annex No. 1 of the category I of the Act), dealt with in total four activities on the territory of the City of Prague (see Table). Since the Act became effective, that is from 1 January 2002 till 31 August 2005 the MOE CR received in total twenty-nine EIA notifications affecting the territory of the City of Prague. Five EIA proceedings were terminated by the conclusion that the activity concerned should be further assessed pursuant to the Act and four decisions were pursuant to Section 10 of the Act were issued.

In the period monitored the Regional Authority of the Central Bohemia Region, as the competent authority, has neither received any notification on a project plan, which would affect the Prague’s territory, nor dealt with any activity, which affected the territory of the City of Prague from the last period. Since the Act became effective till 31 August 2006 the Regional Authority of the Central Bohemia Region has dealt with in total five activities affecting the territory of the City of Prague.

The Act was preceded by the Act No. 244/1992 Code on environmental impact assessment, which has been still valid for assessment of two project plans concerning the territory of Prague (see Table).

Remark: On the basis of the Decision of the Council of the Capital City of Prague No. 0252 of 1 March 2005 the organisational Rules of the Prague City Hall (hereinafter as the MHMP) were changed on 1 April 2005 the way that effective since 1 July 2005 the Department of the Environment of the MHMP (OŽP MHMP) was dismissed and its activities were transferred onto the newly formed Department of Environmental Protection of the MHMP (OOP MHMP) while the Department of Environmental Protection of the MHMP shall take over all rights, claims, obligations, and commitments of the Department of the Environment of the MHMP.
